Morocco Sahara Tours - Terms and Conditions

Please read these Terms and Conditions (“Terms,” “Terms and Conditions”) carefully before using the website (the “Site”) and booking any tours or services (the “Services”) offered by Sahara Tours (“us,” “we,” or “our”).

Your access to and use of the Service is conditioned upon your acceptance of and compliance with these Terms. These Terms apply to all visitors, users, and others who wish to access or use the Service. By accessing or using the Service, you agree to be bound by these Terms. If you disagree with any part of the terms, then you do not have permission to access the Service.

1. Bookings and Reservations

  • Booking Process: When you agree with the quoted travel program and price, we will provide a detailed travel program and invoice with payment details. Your booking is considered confirmed once the required initial deposit has been received by us.
  • Binding Contract: A booking constitutes a binding contract between you (and all persons named on the booking) and Sahara Tours once we have issued a confirmation invoice after receiving your deposit or full payment.
  • Accuracy of Information: You are responsible for providing accurate and complete information at the time of booking. We are not liable for any problems or additional costs arising from incorrect information supplied by you.

2. Payment

  • Deposit: An initial deposit is required to confirm your booking. The amount is typically 25-30% of the total tour price, but this will be specified on your invoice.
  • Final Payment: The remaining balance is generally due locally to our staff prior to the commencement of the tour, unless otherwise specified. Accepted forms of payment for the balance include cash (Euros, US Dollars, UK Sterling, or Moroccan Dirhams).
  • Accepted Payment Methods for Deposit: We accept payments for deposits via Visa, MasterCard, PayPal, and bank transfer.
  • Credit Card/PayPal Fees: Onsite credit card or PayPal payments for the remaining balance may incur an additional processing fee (e.g., 5%), which will be communicated if applicable.
  • Failed Transactions: You will be responsible for any fees incurred due to failed debit/credit card transactions or bounced checks.
  • Foreign Transaction Fees: Clients are responsible for any foreign transaction fees that may be charged by their own bank or credit card provider.

3. Changes and Cancellations by Morocco Sahara Tours

  • Unforeseen Circumstances: We reserve the right to modify or cancel your tour or trek due to unforeseen circumstances beyond our control (e.g., extreme weather, natural disasters, political instability, supplier issues).
  • Notification: We will inform you of any significant changes or cancellations as soon as reasonably possible.
  • Options: If we cancel your tour, we will offer you the choice of:
    • A full refund of all monies paid to us, including the deposit.
    • An alternative tour of comparable standard, if available. If the alternative is of lower value, we will refund the difference; if of higher value, you may be required to pay the difference.
  • Compensation: We are not responsible for paying any additional compensation beyond the refund of monies paid to us for the tour itself (e.g., flight costs, visa fees).

4. Changes and Cancellations by You (The Customer)

  • Requesting Changes: If you need to make changes to your booking, please contact us as soon as possible in writing. We will try to accommodate your request without extra fees, but we cannot guarantee it, especially for changes made close to the departure date (e.g., within 15 days). If changes are not possible, you may proceed with the original booking or cancel subject to the cancellation fees below.
  • Requesting Cancellations: All cancellation requests must be made in writing (e.g., via email) to Sahara Tours.
  • Cancellation Fees: The cancellation fee depends on the number of days before the tour start date that we receive your written cancellation notice. The following general policy applies (specific tours may have different terms, which will be noted on your invoice):
    • Private Desert Tours:
      • More than 30 days before departure: Full deposit refunded (or a nominal administrative fee may apply).
      • Less than 30 days before departure: The initial deposit will be retained as a cancellation fee.
    • Shared Desert Tours / Day Trips & Activities: (Policies may vary, e.g.)
      • More than 7 days (for shared desert tours) or 7 days (for shared day trips) before departure: Full deposit refunded.
      • Less than 7 days (for shared desert tours) or 7 days (for shared day trips) before departure: The initial deposit will be retained as a cancellation fee.
  • Non-Refundable Payments: Please note that some components of your tour (e.g., certain permits, non-refundable flight tickets booked on your behalf) may be non-refundable irrespective of the cancellation period. This will be communicated where applicable.

5. Limitation of Liability

  • Sahara Tours acts as an agent for transportation companies, hotels, and other contractors and shall not be liable for any injury, damage, loss, accident, delay, or irregularity which may be occasioned by reason of any defect in any vehicle or through the acts or omissions of any company or person engaged in conveying you or carrying out the arrangements of the tour.
  • We do not accept responsibility for any personal injury, illness, property loss, death, or disappointment incurred during your trip, unless it is due to the proven negligence of our direct employees. Our liability in such cases will be limited to the maximum amount paid to us for that portion of the travel arrangements.
  • We are not responsible for any unforeseeable events such as acts of terrorism, war, natural disasters, or extreme weather conditions.
  • We are not responsible for missed connections, schedule changes by airlines, or trip interruptions caused by third parties.

6. Customer Special Requests

  • Any special requirements (e.g., dietary, medical, wheelchair assistance, allergies, specific room configurations) must be communicated to us in writing at the time of booking or well in advance of your tour.
  • We will make every effort to accommodate reasonable special requests and will pass this information to our suppliers. However, we cannot guarantee that all requests will be met.
  • Failure to meet a special request will not be a breach of contract on our part unless the request was specifically confirmed by us in writing as being guaranteed. No compensation will be paid if such requests cannot be fulfilled without prior written guarantee.

7. Travel Insurance

  • Travel insurance is strongly recommended for all travelers to protect your investment and cover unforeseen circumstances such as trip cancellation, interruption, medical emergencies, lost baggage, and personal liability.
  • It is your responsibility to ensure you have adequate travel insurance coverage for your specific needs and the activities involved in your tour. Some adventure activities may require specific insurance coverage.
  • We may require proof of travel insurance for certain tours.

8. Traveler's Responsibilities

  • Travel Documents: You are responsible for ensuring you possess all valid and required travel documents, including but not limited to passports (valid for at least 6 months beyond your intended stay), visas, and any necessary health certificates. Sahara Tours is not responsible if you are denied entry to a country or for any transport due to incorrect documentation.
  • Flight Reconfirmation: It is your responsibility to reconfirm flight times with airlines at least 24-72 hours prior to scheduled departures.
  • Health and Fitness: You must ensure you are medically and physically fit for your chosen tour. Please consult your doctor for any health advice or required vaccinations.
  • Local Laws and Customs: You agree to abide by the laws and customs of Morocco during your tour.
  • Communication: You are responsible for communicating any necessary information to us in a timely manner, such as flight schedules for transfers or any issues arising during your tour.

9. Child Policy

For shared desert tours and shared day trips, children under a certain age (e.g., 12 years old) may not be permitted for the comfort of all guests. Please inquire at the time of booking if traveling with children. This policy may not apply to private tours.

10. Privacy

We are committed to protecting your privacy. The personal information we collect from you will be used in accordance with our Privacy Policy. By booking a tour with us, you consent to our collection and use of your personal information as outlined in our Privacy Policy.

11. Complaints

If you have a complaint during your tour, please inform your tour guide or our local representative immediately so that we can attempt to resolve the issue on the spot. If the matter cannot be resolved, please contact us in writing within 28 days of the completion of your tour.

12. Amendments to Terms and Conditions

Morocco Sahara Tours reserves the right to amend these Terms and Conditions at any time. Any such changes will be effective once posted on our website. Your continued use of our Services after any changes constitutes your acceptance of the new Terms.

13. Governing Law

These Terms and Conditions shall be governed by and construed in accordance with the laws of Morocco. Any disputes arising out of or in connection with these Terms shall be subject to the exclusive jurisdiction of the courts of Morocco.
